Ex servicemen Welfare Association, Kadayanallur has been requested that the pension of Ex-Servicemen of the Defence Armed Forces may be exempted from payment of Income Tax.

Rank Pay issue: Law Ministry advisory to Defence Ministry

The constant to and fro of the files pertaining to the Rank Pay case involving veterans has certainly irked the community. However it now seems that the country's top law officer is being made to face the red-tapism, something he is not taking very lightly to.

It has been reliably learnt that while dealing with the Statements of Case (SOC) on this issue from the Ministry of Defence (MoD), in a meeting with the Law Ministry, it as conveyed to the Legal Adviser (Defence) that the ministry should not keep bothering the AG with queries of same/similar nature. Not just that, with this blow, the MoD had no option but to retreat on this and take the SOCs back. Reliable sources say the MoD has to now re-work its SOCs.

Not only will it further delay the case but also add another layer of bureaucratic procedure before the AG's office can be approached. This, it is learnt, was conveyed to LA (Defence) in a meeting on October 28, 2013 which he conveyed to Joint Secretary (Establishment) MoD on October 31. With that move, the SOCs of service headquarters as well as MoD were returned by the AG's office and Law Ministry towards 'framing questions of law pertaining to the case.'

NMC urges PM to appoint chairman of 7th Pay Commission

The National Mazdoor Conference (NMC) today urged Prime Minister Manmohan Singh to immediately appoint chairman and other members of the recently-announced 7th Pay Commission at the next cabinet meeting.

"We urge the PM to appoint Chairman and other members of the 7th Pay Commission and take decision in this regard at the next cabinet meeting as employees and pensioners will be entitled for pay commission with effect from January 1, 2011," NMC president Subash Shastri said while addressing a workers' rally here today.

He said discussion should be started with representatives of both central and state government employees.

The NMC president said early notification for appointing chairman and other members of the commission is the need of the hour, which is bound to have bearing on about one crore employees and pensioners.

Stressing the need for merging 50 percent DA with basic pay and pension, Shastri appealed to the PM and the Finance Minister to take an early decision in this regard.

He said the merging of DA is necessary and it would provide some relief to salaried employees. He also appealed to the state government to immediately release the pending instalment of DA due from July last year.

Govt concerned over clashes among Army officers, jawans

New Delhi, November 24
The government has conveyed its concern to the top brass in the Army over incidents of fracas between jawans and officers.

It has comes in the backdrop of over five such incidents being reported in the Army in the last three years.

The concern was expressed at the recently held Combined Commanders' Conference which was addressed by Prime Minister Manmohan Singh and Defence Minister AK Antony.

The top defence brass was told that the educational and the social background of the jawans have changed in the recent years and there was a need for the officers to handle them in proper manner, sources said.

A need for sensitising the officers regarding their dealings with the jawans was also felt, they said. There have been several such incidents since 2010. — PTI

The Supreme Court has dismissed the review petition filed by the Central Government wherein the government had prayed that the benefits of pension arising out of the rectification of anomalies of pre-2006 pensioners should be granted from September 2012 and not January 2006.

Consequently, all affected defence and civilian pensioners would now be entitled to arrears with effect from January 1, 2006, the date of implementation of the Sixth Pay Commission (SPC), and not just for the past about 14 months as was the government’s intention.

After the plea of the Central Government praying for release of pension arrears from September 2012 rather than January 2006 was dismissed by the Supreme Court in July this year, the Department of Pensions and Pensioners’ Welfare (DoPPW) had referred the file for further action to the law and finance ministries, which then directed the DoPPW to file a review petition.

The controversy on implementation of the SPC recommendations had been simmering for defence as well as civilian pensioners since January 2006. The issue involved the interpretation whether pension would be based on the minimum pay within the pay-band (PB 1,2,3 or 4) or the minimum of pay of the pay-scale applicable to various grades and ranks. Each pay band consists of several pay scales. The Central Administrative Tribunal (CAT) had however ruled in favour of pensioners and had directed re-fixation of pension from January 2006.

An anomaly committee headed by the Cabinet Secretary had finally corrected the anomaly but the arrears of the corrected pension were directed to be released by the government only with effect from September 24, 2012 rather than January 1, 2006.

When the decision of the CAT was challenged before the Delhi High Court, it was again directed by the High Court that arrears would flow from the date of inception of the anomaly, that is, January 1, 2006 and not September 24, 2012. The government had challenged the decision of the Delhi High Court by way of an SLP before the Supreme Court but the SLP was also dismissed.

A similar case filed by Maj Gen K Khorana for military pensioners is pending before the Chandigarh Bench of the Armed Forces Tribunal. Sources said the DoPPW had earlier supported the demands of pensioners but the same had been opposed by the Department of Expenditure in the Ministry of Finance.

Severodvinsk (Russia), November 16
The much-awaited $2.3 billion aircraft carrier, INS Vikramaditya, was today inducted into the Indian Navy in a strategic boost to India's maritime warfare capabilities.
The 44,500-tonne warship was commissioned into the Navy at the Sevmash Shipyard in this northern Arctic port at a handing over ceremony attended by Defence Minister AK Antony, Russian Deputy Prime Minister Dmitry Rogozin and senior government and naval officials of the two countries.
The Russian flag on the vessel was lowered and the flag of the Indian Navy was raised in its place. In a traditional Indian ritual, a coconut was broken against the ship's side. The commissioning papers were signed by deputy director of Russia’s arms exporter Rosoboronexport, Igor Sevastyanov and ship’s captain Suraj Berry, Russia’s RIA Novosti news agency reported. The carrier will be escorted to India on a near two-month voyage. — PTI

The Minister of Railways, Shri Mallikarjun Kharge has congratulated legendary cricketer Sachin Tendulkar and eminent scientist Professor C.N.R. Rao on being selected for the “Bharat Ratna Award.”

In a congratulatory message to Master Blaster Sachin Tendulkar, Shri Kharge said that Sachin has been hailed as a true Ambassador of India in the world of sports and his contribution and unmatched achievements in sports will always be remembered. Shri Kharge said that Sachin won glory for India and his life and career will be a great source of inspiration for millions of youth in India and abroad. Conferring India’s highest civilian award on him will go a long way in promoting sports and encouraging sportspersons in the country, the Railway Minister added. Shri Kharge hoped that Sachin would continue to provide guidance to Indian cricket and budding cricketers in the years to come.

Congratulating Professor C.N.R. Rao, Shri Kharge said that Professor Rao is a well recognised international authority on solid state and materials chemistry. Professor Rao has enriched the scientific world through his thousand research papers and many published books. Professor Rao has been contributing immensely in his capacity as the current Chairman of the Scientific Advisory Council to the Prime Minister. Professor Rao has many National and Internationals awards to his credit. “Bharat Ratna Award” to him will motivate and inspire scientists, researchers, academicians and students in a big way. This is also a moment of pride and honour for Karnataka, which professor Rao belongs to, the Railway Minister added.

1  To examine with a view to having a proper pension structure for pensioners and family pensioners both past and future so that all pensioners irrespective of pre retirement status get equal percentage rise in pension through full parity as well as through normal consolidation.

2  To examine the existing pension structure including death-cum-retirement, commutation of pension and other terminal or recurring benefits, upholding the principal of Parity in Pension between past and future pensioners as recommended by V CPC and make recommendations there to be effective from 01.01.2006.

3  To consider the merger of Dearness Relief wef 1.1.2011 and grant of suitable Interim Relief with immediate effect.

4  To consider the unimplemented recommendation of 5th & 6th CPC.

5  To consider enhancement of% of pension & family pension

6  To examine various health schemes in the light of apex court judgments on the subject & suggest improvements so that all pensioners including those of all India services like IAS, irrespective of pre retirement status get hassle free medical facilities at par .

7  To examine FMA with reference to prevailing market conditions & to suggest enhancement w/o any distance restriction.

8  To examine the scheme of excratia payment to SRPF and CPF retirees and to concider and enhancement in it to the level of minimum pension.

9  These recommendations will  to apply all Central Government Pensioners,Ex servicemen,Pensioners of those PSUs like Prashar Bharti,BSNL,MTNL,FCI consttuted by absorbing the respective Departmental Employees.

REIMBURSEMENT OF MED CLAIM FOR EMERGENCY TREATMENT IN NON EMPANELLED HOSPITAL

1. A Clarification was sought from the Chief Medical Officer (SAG), CGHS Mumbai on the rates at which the claims are settled of CGHS beneficiaries. The CGHS authorities have clarified vide their letter No. 3(xiv)3/13 Gen1/1958/13 dt 30 Aug 13 that reimbursement at 25% higher rate that the 2002 CGHS rates is applicable to those who have taken treatment in private non empanelled hospital through CGHS in Mumbai.

2. Based on the above provision provided by CGHS reimbursement at 25% higher rates that 2002 CGHS rates will also be applicable to those ECHS members who have taken any emergency treatment in a non empanelled hospital for or for those undergoing any planned listed procedure in a non empanelled hospital after taking prior sanction of Central Org ECHS.

3. The above orders are applicable till further instructions.
