The Principal Bench of Armed Forces Tribunal has dismissed the review petition filed by the Union of India citing that the officers who become substantive Majors or equivalent before January 1, 1996 are granted the scale of Lieutenant Colonel or equivalent on completion of 21 years of commissioned service i.e. in their 22nd year, with rank pay of Major. The benefit of this upgradation was only to be given to those officers in the rank of Major who were in service on January 1, 1996.
