OROP arrears will be disbursed - Let us wait for two more days

Dear Veterans,
I am told the hearing for extension of three more months from 16 Jun to 15 Sep 2019 is to be heard by the Supreme Court bench headed by Justice Dr Chandrachud on 16 Sep 2022. We may here what happens only on 17 Sep 2022 if the Addl SG representing Min of Def does not abscond from hearing.
In my view if it hearing then both parties are likely to be called i.e. Min of Def and IESM.
IESM  will vehemently oppose grant of extension. Their argument is going to be like this.
OROP - I arrears was made on the basis of those retired in calendar year 2013 by taking average pension drawn by them for all ranks for various pensionable service. The new pension tables were isused and pensioner were disbursed arrears accordingly with all anomalies. The same procedure is to be adopted if Govt of India has not agreed to implement One Man Judicial Committee Reprort of Justice L Narasimha Reddy to go into anomalies of OROP. The PPOs of all thsoe retired in calendar year 2018 would definitely be available with PCDA (Pensions) Prayagaraj by end of Dec 2018. Thus they could have easily worked out average pension of all ranks by Jun 2019 and commence disbursal of pension by Jul 2019. The sub judice is just an excuse to delay the disbursal of arrearas. Nothing would stop Min of Def to disburse the pension as per their own policy letter on OROP which means five yearly revision. Therefore Min of Def (ESW) has no reason to ask for extension by three more months. If Hon'ble Supreme Court gives extension then penal interest of 8% also be paid from Jul 2019. The Hon'ble Supreme Court is requested to find out from Min of Def (ESW) what was done from Jan 2019 to Mar 2022 regarding making pension tables.
The other option is to grant extension of three months without any penalty.
Let us wait for two more days to know how OROP arrears will be disbursed.
This is my view.
Warm regards,
