The most important and very very urgent msg for all the Lt Cols (SG) and Military equivalents, all the Majs and military equivalents with 13 or more years rendered length of Commissioned Service and retired prior to 16 Dec 2004.

1. Below I am penning down a very very important and fruitful msg with a very good and fantastic news for all of us, a sincere request pl read and act on this msg urgently as the time is very short:-

2. Cdr (SG) Ilangovan from Chennai have won the case of the pension of Capt in the AFT Chennai on 21 Sept 2021, there by means that the Lt Col (SG) retired prior to 16 Dec 2004 have been given the pension of the next higher rank i.e Col(TS). This judgement is applicable to all the Lt Cols SG and Military equivalents. But ironically as usual the MoD have gone for the SLP in the SC against this judgement and not given him the pension of the next higher rank.

Yesterday there was the final hearing of our on going case in the AFT Chandigarh  of the Majs and military equivalents retired prior to 16 Dec 2004 with 13 or more years rendered length of Commissioned Service. At the conclusion of the arguments the Judge was fully convinced and agreed with our arguments and said that your case is akin to the case of Cdr Ilangovan and the same judgement will be applicable to your case too, on hearing this some body brought out to the notice of the Judge that the MoD have taken the stay order on this judgement by filling the SLP in the SC, on this the judge said that then pl wait for the out come of this SLP in the SC and the same will be applicable to your case too and I will mention that in the judgement and that will close the doors for the MoD to go to SC.

Dear All,now the moot question arises and i.e that it has become utmost important for all mentioned ranks to get this SLP of the MoD dismissed in the SC if that is not done then for all these effected ranks the doors for the grant of pension of next higher rank will be closed once for all and for ever.

5. Keeping the above development in mind and the importance and the urgency of the matter I thought it to be prudent on part to get in touch with Cdr Ilangovan for the benefit of all these ranks. After lot of efforts I was lucky enough to get the cell number of Cdr Ilangovan. Spoke with him at length just now about the whole case and the progress on this SLP. To be very forthright,he told me that the MoD have filled the SLP in the SC against this judgement and the next date of hearing is 23 Jan 2023.He was very upright and told me that no body is coming forward to help him in any manner and he is totally exhausted physically and financially and is not in a position to contest this SLP in the SC, till now he has spent lot of money alone to fight this case in the AFT. Seeing the gravity of the matter I volunteered to fight against this SLP in the SC on his behalf, on this he felt very very happy and relaxed and told me that he will give all his assistance as far as the arguments and the Vakalatnama are concerned.

6. Now as the case involves huge financial benefits to all the Lt Cols SG and Military equivalents w.e.f 01 Jan 2006 at all India level ranging in the tune of 10-15 thousand Rs per month and much more after the OROP, this involves very huge arrears too.  For all  the Majs and military equivalents the benefit is much much higher and is in the tune of 10-40 thousands Rs per month, the arrears will be very very huge.

7. I have taken on the onus and the responsibility to do all the running around in the SC and find the best advocates available in the SC to fight the battery of the AG's and the SGs of the MoD, I have given the assurance on this to Cdr Ilangovan.Keeping this development in view we need the financial contribution from all the effected ranks at all India level that may be in the tune of 10-15 thousands Rs per head which is a peanut comparing the huge benefits involved. We have already got a dedicated account for this purpose and every penny is accounted for, the details of the same will be shared immediately on hearing the willingness to contribute. This willingness can be given to me directly or to the Sqn Ldr YS Nijjar or Col SK Thakur or other gps can be formed and one volunteer can be in touch with me.
