Changes in Disability Pension Rules No Minimum Service Limit in Certain Cases

The
Department of Pensions and Pensioners Welfare, Ministry of Personnel, Public Grievances and Pensions, Government of India, vide O.M. No.21/01/2016-P&PW(F) dated 12 February 2019 provides that any public servant who is permanently deprived of service before completing the mandatory 10 years of service due to physical or mental defect shall be eligible for disability pension also subject to certain conditions. This provision is based on the Government of India official notification No. 21/01/2016-P&PW(F) dated 1 April 2019.

A proposal to extend the provisions of Ministry of Pensions & Pensioners Welfare Notification No. 21/01/2016-P&PW(F) dated 12th February 2019 to military personnel is being considered by the Ministry. The undersigned is directed to declare that in future, disability pension will also be granted to servicemen with less than 10 years of service if their disability is due to a physical or mental defect not attributable to or aggravated by military service, and is permanently disqualified from service and excluded from reinstatement in military service, resulting in dismissal from military service. An assurance has been given that the military pension scheme will be changed in due course.

DESW
also stated that the provisions of the letter will be applicable to military personnel who have served or are serving after 4 January 2019. Cases of relatives discharged before 4 January 2019 will not be reopened.

They
also confirmed that all other conditions remain unchanged. The letter was prepared with the approval of the Ministry of Finance pursuant to U.O. No. 10(08)/2016/FIN/PEN, issued on 29 June 2020. You can download a PDF copy of the original letter from DESW dated July 16, 2020 using the link below.
