Service as sailor to be counted for fixing officer’s pension

Chandigarh Bench of Armed Forces Tribunal has held that a sailor, who later gets commissioned in the Navy as an officer, can claim a sailor’s pension after the completion of 15 years of service, in case he does not complete 20 years of service as is required for grant of pension for commissioned officers.

Naval Lt DS Rai had joined Navy as a sailor and was later commissioned as an officer. He voluntarily resigned from service after completing more than 15 years service. He was refused pension on the grounds he had retired as an officer and thus required 20 years of service to qualify for pension. His plea for grant of pension at sailors’ rates on completion of 15 years of service was rejected on the ground that though rules permitted counting of sailor service or service in ranks towards commissioned service, rules were silent on counting of officers’ service into sailor service. — TNS
