Purpose of this website


             Pensioners of the Armed Forces  are different from  pensioners of  other departments of the Government of India. Some rules and regulations apply to public services. In order to sensitize them about the various rules, regulations, government programs related to ex-servicemen and the various social assistance programs for families of ex-servicemen, we refer to the government instructions on this subject. , published information on related topics. Here, we will discuss SPARSH, CSD, ECHS, OROPfamily pension, disability pension, Service pension, re-employment with life certificate and other welfare activities  to increase the awareness of beneficiaries.

LIFE TIME ARREARS (LTA) - NOMINATION

Dear Veterans,
Please note that there is "Rule 5" under the "Payment of Arrears of Pension (Nomination) Rules, 1993" and also Def Pension Instructions at page 206, which is not known to most of us, the LNomination for Life time Arrears has been dealt at length.
It has been authentically confirmed from PCDA (Pensions) that the Rules do not permit payment of Life Time Arrears , if any, which may accrue, pertaining to the period of when the pensioner was alive, after his/her demise, unless there is a proper nomination made by the pensioner/family pensioner to the effect during his life time. In cases where there is no nomination the procedure to get the arrears is tortuous as the legal heirs will need to get succession certificates from the court. Apparently, payment of arrears is governed differently from the payment of family pension, irrespective of the fact that wife’s name is included in the PPO & the pension account is held jointly with her.

The nomination is a must for the family pensioners since generally there are no eligible members of the family after the demise of the Family Pensioner and must be done post haste. It is also applicable as a must for pensioners whose spouses may have already deceased and thereafter no eligible family members may be there after the pensioner. Do act today if you haven't acted in the past on our earlier advice given through mails and blog sites . I will insist that all of us must give this nomination even if your spouse is there since the nomination form has two sets of nominees first the spouse the the second children, who then will automatically become nominees in case of the demise of the spouse or under contingency of accidental death of the pensioner and the spouse. Even if you have doubts it is better to make your Nomination in the Form B to Rule 5 as given below & submit it to your PDA and obtain acknowledgement.

REFUSAL BY BANKS TO ACCEPT LTA NOMINATION

Many offrs have reported that Some of the PDAs specially the SBI in and around Delhi are not accepting the LTA Nomination. This is short sightedness on their part. PCDA(P) circular No 145 deals on this subject. This circular is reproduced below and can also be downloaded from the PCDA web site. While the LTA can be paid to the eligible Family Pensioners, i.e. Parents, daughters and handicapped Children by the bank on the authority of the said circular but not to others without the succession certificate unless the required nomination is made as explained above. LTA nomination is different from the bank account nomination.
This has been explained in detailed under the Nomination Post in this site. It refers to the other than eligible members as given in Clause (b) of sub-rule (14) of Rule 54 of the CCS (Pension) Rules, 1972, reproduced at the end of this post. The case of refusal by the banks is generally with many pensioner clients of SBI, The branch manager in such cases be asked in writing as to how he will allow LTA to be paid to the family member other than family pensioner when the contingency arises since only the one who draws the family pension will be paid LTA due pertaining to the life time of pensioner. This provision of payment of LTA to Family pensioners in the normal chain ie Spouse, Parents, unmarried/divorsed daughters and handicapped children is now being given in Govt letters and circulars, but then who will get it after the demise of last FP without obtaining succession from revenue authorities. The LTA nomination is in very much in this context. Plz do share with me what written reply your branch manager gives to you.

2. However, no such similar provisions were in existence for Defence pensioners. Accordingly the matter was referred to Ministry of Defence for extending the above said provisions to Defence pensioners also.
3. Ministry of Defence, vide their letter No.1(16)/2009-D(Pen/Policy) dated 15.03.2010( copy enclosed) have now decided that provisions of Govt of India, Deptt. of Pension & Pensioners’ Welfare OM No.43/4/95-P&95- P&PW (G) dated 30.10.1995 will apply mutatis-mutandis to the Armed forces Personnel.
4. In view of the above, it is requested that all pension paying branches/treasuries/DPDOs/PAOs under your jurisdiction may be instructed to keep in mind the above provisions while regulating the life time arrears of pension/family pension. (D.C.HANSDA)

(ii) A judicially separated wife or husband, such separation not being granted on the ground of adultery and the person surviving was not held guilty of committing adultery.
(iii) Son who has not attained the age of ‘twenty-five years and unmarried daughter who has not attained the age of twenty-five years, including such son and daughter adopted legally.’

NOTE – Wife and husband shall include respectively judicially separated wife and husband. Divorced daughters and handicapped children have also been included.
