Likely Pension w.e.f Jul 2019
1. Likely pension arrears now that Hon’ble Supreme Court have given direction to Govt of India to implement revision of pension w.e.f. Jul 2019 within a period of three months i.e. by 16 Jun 2022 and disburse arrears accordingly. Air Mshl SY Savur, PVSM, AVSM, former AOC-in-C, Southern Air Comd obtained presentation on OROP – 2019 made by PCDA (Pensions) Prayagraj to Jt Secy, Min of Def on 24 Apr 2019 through the route of RTI Act. The slides show the average pension by Maximum and Minimum of those retired in calendar year 2018. The data for JCOs / OR of X Group and of Lts and Capts is not given. So we have to wait for pension tables similar to Circular 555 which are expected to be put up in public domain in few months' time but definitely by 16 Jun 2022. But taking whatever data PCDA (Pensions) Prayagraj gave to Min of Def, I made an endeavour to make some of tables of pension similar to Circular 555 for OROP with financial benefit from Jul 2014.
2. From the slides of PCDA (Pensions) Prayagraj, it is seen certain anomalies have arisen as under:-
(a) Some of the OROP beneficiaries (Pre – Jun 2014) get higher pension (pension of Dec 2015 x 2.57) than the pension of those retired in calendar year 2018. The reason is OROP hikes pension of those who drew less than average pension to that of average. But post – 2014 retirees are not covered by OROP hence those whose pension is below average continue to get lesser pension than Pre – Jun 2014 pensioners. The Hon’ble Supreme Court has advised the learned Addl Solicitor General to make pension of Post Jul 2014 retirees same as that of OROP beneficiaries. I hope in the next table from PCDA (Pensions) Allahabad this anomaly could be rectified.
(b) Pre – 2006 Hony Nb Subs are still not being given pension of Nb Subs.
(c) Lt Cols with service of 26 years and above have been granted rank of Col (TS) w.e.f. 16 Dec 2004 due to implementation of AVS committee. The pension of Pre – Dec 2004 Lt Cols with QS (qualifying service) of 26 years may be same as that of Lt Col with 25.50 years retired in calendar year 2018. This is another anomaly.
(d) One Major with QS of 21.50 years’ service retired in calendar year 2018 got pension fixed at Rs 68,550.Hence all Pre – Jun 2014 Majors are likely to get same pension.
(e) Those retirees whose pension in Dec 2015 x 2.57 is higher than Average pension of those retired in calendar year 2018 will not get any arrears w.e.f. Jul 2019 as thier current pension is higher than the revised pension from Jul 2019.
(f) Pension of X group of JCOs / OR are not shown by PCDA (Pensions) Allahabad, hence the same are not shown in these tables.
4. The criterion adopted in circular 555 for revision of pension w.e.f. Jul 2104 is as follows and the same is adopted: -
(a) For any one rank say Lt Col, the pension of a retiree with a longer service of say 24 years cannot be less than pension of another Lt Col with QS of 23 years.
(b) For the same qualifying service higher ranked retiree say Lt Col cannot have lesser pension than a Major with same qualifying service.
5. Medical Officers from AMC, AD Corps and RVC. In OROP - 2014, the pension for all officers of the rank of Lt Col with 22.50 years service to DGAFMS were fixed at Rs 42,500 which is pension of Lt Gen (HAG) of non - medicos. I presume the same is likely to be repeated in OROP - 2019. The pension of Lt Gen (HAG+) w.e.f. Jul 2019 is likely to be Rs 1,12,500 + DR pm.

Maj Madhu Lall (Retd) a senior veteran with qualifying service (QS) of 20.50 years of his likley pension arrears w.e.f. Jul 2019. I found that his present pension of Dec 2015 x 2.57 is higher than pension arrived by average method of those majors retired in calendar year 2019. Hence such retirees do not get benefit of arrears as they continue to draw higher pension than in OROP. May be in OROP revision w.e.f. Jul 2024, they may get higher pension. The average method of pension fixation is thus not beneficial to all. If one Major or any other ranked retiree gets lower pension by 0.50 x last reckonable emoluments for a variety of reasons then the Average pension comes down affecting all previous retirees. Please go through my analysis of pension of Majors w.e.f. Jul 2019 in your spare time as you need lot of patience to understand what I tried to convey.

1. You raised a very interesting issue saying your service is 20 years and 8 months and your pension arrears are not shown in the table of pensions I made in next OROP with financial benefit from Jul 2019. Now this simple query of yours needs an elaborate explanation. For this you need to see Circular 555 of pensions in OROP w.e.f Jul 2014 to find out how did they fix pension for various ranks with varying length of Service (Qualifying Service – QS). You see the pension of Majors is shown like this in Circular 555 for fixation of pension w.e.f Jul 2014 in OROP.

3. You can now deduce the following four criterion adopted in Circular 555 for fixation of pension w.e.f. Jul 2014 for any ranked retiree: -
(a) Only One Major Retired with a QS. Find out who all retired in calendar year 2013 with a QS and what is their pension by 50% of last reckonable emoluments (pay in pay band + grade pay + MSP). If you see Maj Kishore Kumar with QS of 22 yrs retired with pension of Rs 23,815 pm based on 50% last reckonable emoluments. There is no other major with QS of 22 years retired in calendar year 2013. Therefore, his pension of Rs 23,815 by last reckonable emoluments is to be taken as Average pension for all Pre – Jun 2014 pensioners whose pension is fixed as per OROP. In this case, all Majors retired prior to OROP with QS of 22 years or more will get pension of Rs 23,815 pm + DR.
(b) Majors with Longer QS than Major with 22 years QS. You find there are four Majors with QS of 22.50 to 33 plus years retired in calendar year 2013 in the list obtained by Maj SK Jain. They got lesser pension by last reckonable emolument method than Rs 23,815 pm of Maj Kishore Kumar with QS of 22 years. Thus, all the four majors with higher QS than Maj Kishore Kumar got financial benefit by getting their pension hiked to average of Rs 23,815. See Maj S Srinivas Rao with QS of 24 years whose pension at the time of retirement is only Rs 18,020 but due to OROP it got enhanced to Rs 23,815 pm i.e hike of Rs Rs 5,795 pm (= 23815 – 18020). He gained 32% increase in pension along with three more majors. On this enhanced pension he gets DR too!
(c) Two Or More Majors with Same QS but with Different Pensions. In case two or more Majors retired with same QS in calendar year 2013, then their average pension is to be worked out. In this case there are two majors with QS of 20.50 years retired in calendar year 2013. Maj AKP Jha with pension of Rs 22,455 pm and Maj S Girish Kashyap with pension of Rs 23,205 pm are the only two officers retired with QS of 20.50 years. The average is (22455 + 23205)/2 = Rs 22,830. In this case Maj AKP Jha whose pension by last reckonable emoluments is only Rs 22,455 (lesser than average of Rs 22,830) got enhanced to Rs 22,830 and thus he got financial of Rs 375 pm (22830-22455) benefit due to OROP. Maj S Girish Kashyap whose pension by last reckonable emoluments is Rs 23,205 will continue to get Rs 23,205 as higher pension earned cannot be reduced.
(d) Pension of Higher Ranked Retiree Cannot be Less than Junior Ranked Retiree with Same Qualifying Service. See the table of pension of all those retired with QS of 20 years as under: -

Note: It shows that higher ranked retiree with same QS of 20 years cannot have lesser pension than lower ranked retiree. Col SG to Lt Gen (HAG) at 20 years’ service will not get pension lesser than that of Col (TS).
4. I, when working out the likely pensions w.e.f.Jul 2019 as per the request of many members of TSEWA in t OROP revision w.e.f.Jul 2019 took these four criterion in my calculations. Because the method of pension fixation was not commented by Hon’ble Supreme Court in their judgment delivered on 16 Mar 2022. Therefore, the Min of Def in all likelihood will adopt the same method of pension fixation as was done in 2013 with financial benefit from Jul 2014 for revision of pension w.e.f. Jul 2019.
5. Now you see the pension of all Pre- OROP Majors with QS of 13 to 20 years is fixed at Rs 21,530 in Circular 555. As per reduction of pension by 3% per year or 1.5% per six months then pension of Major with 20.50 was fixed at Rs 22,830 by the average method I explained at para 3(c). Then pension of Major with 20 years should be reduced by 1.5% from Rs 22,830 pmi.e. Rs 22830 x 0.985 = 22,488 pm.Then, why was it fixed at Rs 21,530? It is very clear that there was one more major (nineth major) who retired with QS of 13 years with pension of Rs 21,530 (this information was not given to Maj SK Jain). Therefore, all Pre – OROP Majors with QS of 13.50 to 20 years is fixed the same pension of Rs 21,530.
6. It therefore boils down to one simple fact: Find out who all retired with varying QS and work out their pension either by average method if two or more retirees retired with same QS or only one retired with the same QS. Then fix pension of all those who retired with higher QS but lesser pension (see the four majors with QS higher than 22 years) the same pension as that of the one who retired with QS lesser (22 years of Maj Kishore Kumar). That is, all Pre – OROP Majors with QS of 13 to 20 will get same pension of Major with 13 years QS and actually retired in calendar year 2013. There were no majors with QS of 13.50 to 20 years retired in calendar year 2013. You have to draw such conclusions with the data given to you.
7. You may have a genuine doubt that how could a Major with 13 years QS get pension when minimum service required to earn pension is 20 years. As per the judgment of Hon’ble Supreme Court if a soldier is medically boarded out being unfit for military service (invalided) then his pension should be fixed for the length of service he might have rendered even if it is less than 20 years’ service. In this case, you can assume that there was one major with 13 years QS and invalided in calendar year 2013 with pension of Rs 21,530 pm. That is the only conclusion anyone can draw.
8. Now come to the likely pension of Majors in OROP revision w.e.f. Jul 2019. Air Mshl SY Savur, PVSM, AVSM(Retd) got the following data by RTI route from Min of Def (ESW) of Majors retired in calendar year 2018 as shown below: -

Likely Pension w.e.f Jul 2019
1. Likely pension arrears now that Hon’ble Supreme Court have given direction to Govt of India to implement revision of pension w.e.f. Jul 2019 within a period of three months i.e. by 16 Jun 2022 and disburse arrears accordingly. Air Mshl SY Savur, PVSM, AVSM, former AOC-in-C, Southern Air Comd obtained presentation on OROP – 2019 made by PCDA (Pensions) Prayagraj to Jt Secy, Min of Def on 24 Apr 2019 through the route of RTI Act. The slides show the average pension by Maximum and Minimum of those retired in calendar year 2018. The data for JCOs / OR of X Group and of Lts and Capts is not given. So we have to wait for pension tables similar to Circular 555 which are expected to be put up in public domain in few months' time but definitely by 16 Jun 2022. But taking whatever data PCDA (Pensions) Prayagraj gave to Min of Def, I made an endeavour to make some of tables of pension similar to Circular 555 for OROP with financial benefit from Jul 2014.
2. From the slides of PCDA (Pensions) Prayagraj, it is seen certain anomalies have arisen as under:-
(a) Some of the OROP beneficiaries (Pre – Jun 2014) get higher pension (pension of Dec 2015 x 2.57) than the pension of those retired in calendar year 2018. The reason is OROP hikes pension of those who drew less than average pension to that of average. But post – 2014 retirees are not covered by OROP hence those whose pension is below average continue to get lesser pension than Pre – Jun 2014 pensioners. The Hon’ble Supreme Court has advised the learned Addl Solicitor General to make pension of Post Jul 2014 retirees same as that of OROP beneficiaries. I hope in the next table from PCDA (Pensions) Allahabad this anomaly could be rectified.
(b) Pre – 2006 Hony Nb Subs are still not being given pension of Nb Subs.
(c) Lt Cols with service of 26 years and above have been granted rank of Col (TS) w.e.f. 16 Dec 2004 due to implementation of AVS committee. The pension of Pre – Dec 2004 Lt Cols with QS (qualifying service) of 26 years may be same as that of Lt Col with 25.50 years retired in calendar year 2018. This is another anomaly.
(d) One Major with QS of 21.50 years’ service retired in calendar year 2018 got pension fixed at Rs 68,550.Hence all Pre – Jun 2014 Majors are likely to get same pension.
(e) Those retirees whose pension in Dec 2015 x 2.57 is higher than Average pension of those retired in calendar year 2018 will not get any arrears w.e.f. Jul 2019 as thier current pension is higher than the revised pension from Jul 2019.
(f) Pension of X group of JCOs / OR are not shown by PCDA (Pensions) Allahabad, hence the same are not shown in these tables.
4. The criterion adopted in circular 555 for revision of pension w.e.f. Jul 2104 is as follows and the same is adopted: -
(a) For any one rank say Lt Col, the pension of a retiree with a longer service of say 24 years cannot be less than pension of another Lt Col with QS of 23 years.
(b) For the same qualifying service higher ranked retiree say Lt Col cannot have lesser pension than a Major with same qualifying service.
5. Medical Officers from AMC, AD Corps and RVC. In OROP - 2014, the pension for all officers of the rank of Lt Col with 22.50 years service to DGAFMS were fixed at Rs 42,500 which is pension of Lt Gen (HAG) of non - medicos. I presume the same is likely to be repeated in OROP - 2019. The pension of Lt Gen (HAG+) w.e.f. Jul 2019 is likely to be Rs 1,12,500 + DR pm.

Maj Madhu Lall (Retd) a senior veteran with qualifying service (QS) of 20.50 years of his likley pension arrears w.e.f. Jul 2019. I found that his present pension of Dec 2015 x 2.57 is higher than pension arrived by average method of those majors retired in calendar year 2019. Hence such retirees do not get benefit of arrears as they continue to draw higher pension than in OROP. May be in OROP revision w.e.f. Jul 2024, they may get higher pension. The average method of pension fixation is thus not beneficial to all. If one Major or any other ranked retiree gets lower pension by 0.50 x last reckonable emoluments for a variety of reasons then the Average pension comes down affecting all previous retirees. Please go through my analysis of pension of Majors w.e.f. Jul 2019 in your spare time as you need lot of patience to understand what I tried to convey.
Dear Maj Madhu Lall Sir,
1. You raised a very interesting issue saying your service is 20 years and 8 months and your pension arrears are not shown in the table of pensions I made in next OROP with financial benefit from Jul 2019. Now this simple query of yours needs an elaborate explanation. For this you need to see Circular 555 of pensions in OROP w.e.f Jul 2014 to find out how did they fix pension for various ranks with varying length of Service (Qualifying Service – QS). You see the pension of Majors is shown like this in Circular 555 for fixation of pension w.e.f Jul 2014 in OROP.

2. Maj SK Jain obtained information through RTI Act as to how many Majors retired with varying QS in the calendar year 2013. The data is shown below: -

3. You can now deduce the following four criterion adopted in Circular 555 for fixation of pension w.e.f. Jul 2014 for any ranked retiree: -
(a) Only One Major Retired with a QS. Find out who all retired in calendar year 2013 with a QS and what is their pension by 50% of last reckonable emoluments (pay in pay band + grade pay + MSP). If you see Maj Kishore Kumar with QS of 22 yrs retired with pension of Rs 23,815 pm based on 50% last reckonable emoluments. There is no other major with QS of 22 years retired in calendar year 2013. Therefore, his pension of Rs 23,815 by last reckonable emoluments is to be taken as Average pension for all Pre – Jun 2014 pensioners whose pension is fixed as per OROP. In this case, all Majors retired prior to OROP with QS of 22 years or more will get pension of Rs 23,815 pm + DR.
(b) Majors with Longer QS than Major with 22 years QS. You find there are four Majors with QS of 22.50 to 33 plus years retired in calendar year 2013 in the list obtained by Maj SK Jain. They got lesser pension by last reckonable emolument method than Rs 23,815 pm of Maj Kishore Kumar with QS of 22 years. Thus, all the four majors with higher QS than Maj Kishore Kumar got financial benefit by getting their pension hiked to average of Rs 23,815. See Maj S Srinivas Rao with QS of 24 years whose pension at the time of retirement is only Rs 18,020 but due to OROP it got enhanced to Rs 23,815 pm i.e hike of Rs Rs 5,795 pm (= 23815 – 18020). He gained 32% increase in pension along with three more majors. On this enhanced pension he gets DR too!
(c) Two Or More Majors with Same QS but with Different Pensions. In case two or more Majors retired with same QS in calendar year 2013, then their average pension is to be worked out. In this case there are two majors with QS of 20.50 years retired in calendar year 2013. Maj AKP Jha with pension of Rs 22,455 pm and Maj S Girish Kashyap with pension of Rs 23,205 pm are the only two officers retired with QS of 20.50 years. The average is (22455 + 23205)/2 = Rs 22,830. In this case Maj AKP Jha whose pension by last reckonable emoluments is only Rs 22,455 (lesser than average of Rs 22,830) got enhanced to Rs 22,830 and thus he got financial of Rs 375 pm (22830-22455) benefit due to OROP. Maj S Girish Kashyap whose pension by last reckonable emoluments is Rs 23,205 will continue to get Rs 23,205 as higher pension earned cannot be reduced.
(d) Pension of Higher Ranked Retiree Cannot be Less than Junior Ranked Retiree with Same Qualifying Service. See the table of pension of all those retired with QS of 20 years as under: -

Note: It shows that higher ranked retiree with same QS of 20 years cannot have lesser pension than lower ranked retiree. Col SG to Lt Gen (HAG) at 20 years’ service will not get pension lesser than that of Col (TS).
4. I, when working out the likely pensions w.e.f.Jul 2019 as per the request of many members of TSEWA in t OROP revision w.e.f.Jul 2019 took these four criterion in my calculations. Because the method of pension fixation was not commented by Hon’ble Supreme Court in their judgment delivered on 16 Mar 2022. Therefore, the Min of Def in all likelihood will adopt the same method of pension fixation as was done in 2013 with financial benefit from Jul 2014 for revision of pension w.e.f. Jul 2019.
5. Now you see the pension of all Pre- OROP Majors with QS of 13 to 20 years is fixed at Rs 21,530 in Circular 555. As per reduction of pension by 3% per year or 1.5% per six months then pension of Major with 20.50 was fixed at Rs 22,830 by the average method I explained at para 3(c). Then pension of Major with 20 years should be reduced by 1.5% from Rs 22,830 pmi.e. Rs 22830 x 0.985 = 22,488 pm.Then, why was it fixed at Rs 21,530? It is very clear that there was one more major (nineth major) who retired with QS of 13 years with pension of Rs 21,530 (this information was not given to Maj SK Jain). Therefore, all Pre – OROP Majors with QS of 13.50 to 20 years is fixed the same pension of Rs 21,530.
6. It therefore boils down to one simple fact: Find out who all retired with varying QS and work out their pension either by average method if two or more retirees retired with same QS or only one retired with the same QS. Then fix pension of all those who retired with higher QS but lesser pension (see the four majors with QS higher than 22 years) the same pension as that of the one who retired with QS lesser (22 years of Maj Kishore Kumar). That is, all Pre – OROP Majors with QS of 13 to 20 will get same pension of Major with 13 years QS and actually retired in calendar year 2013. There were no majors with QS of 13.50 to 20 years retired in calendar year 2013. You have to draw such conclusions with the data given to you.
7. You may have a genuine doubt that how could a Major with 13 years QS get pension when minimum service required to earn pension is 20 years. As per the judgment of Hon’ble Supreme Court if a soldier is medically boarded out being unfit for military service (invalided) then his pension should be fixed for the length of service he might have rendered even if it is less than 20 years’ service. In this case, you can assume that there was one major with 13 years QS and invalided in calendar year 2013 with pension of Rs 21,530 pm. That is the only conclusion anyone can draw.
8. Now come to the likely pension of Majors in OROP revision w.e.f. Jul 2019. Air Mshl SY Savur, PVSM, AVSM(Retd) got the following data by RTI route from Min of Def (ESW) of Majors retired in calendar year 2018 as shown below: -

9. But I suggest you wait for the pension tables to be issued by PCDA (Pensions) Allahabad by 16 Jun 2022 and hope that my understanding is incorrect and hope you may get higher pension in OROP w.e.f. Jul 2019.
