PENSION TO ALL PRE DEC 2004

*GETTING PENSION OF COL(TS) TO ALL PRE DEC 2004 LT COLS - OA - 664/ 2016 IN AFT*

Dear applicants of AFT-6,

1.   There are some unnecessary rumors being spread  that TSEWA has not included all the 301 applicants in AFT-6 case. This is not correct. The case has all the 301 Litigants. The clarification received from Brig SKS Rana, VSM, President of our Legal Division and our Advocate Brig Srivastava is given below. It is the responsibility of TSEWA to ensure that the judgment is given in respect of all the litigants. Kindly be rest assured that the needful will be done.

1.     Regarding the case of Lt Col K P Radhakrishnan and others. "In the Last Hearing the Court Questioned the Counsel of Opp Party, As to why the Counter has not been filed in the Case albeit over 4 years have passed.Opposite side gave the same old excuse, that there are so many Applicants from Different Arms and Services and they are not getting Comments from them, hence helpless to Compile Counter.On a cue from Court, Myself took the Initiative to state, that Let the Opp Party file CA in respect of only the Lead Applicant and if we succeed,the same Judgement would be made Applicable to all Others,if the order is passed in rem or else based on the Judgement, Another case will be filed covering all other applicants."
I think in a given situation this is the best alternative adopted by Brig AK Srivastava VSM regarding this case.
