DISABILITY PENSION AND ITS ELIGIBILITY

Respected Veterans,
As many of you may be aware that the following two conditions are to be fulfilled for grant of disability pension:

(i) Degree of disablement must be 20% or more
(ii) Disability must be attributable to or aggravated by service.
But, it is seen that as a routine practice, a large number of servicemen, who are discharged in low medical category, are denied disability pension by simply holding their disability as Neither Attributed to Nor Aggravated by Service (NANA). Also, many a times the disability is held 15-19% in a highly arbitrary and mechanical manner.  In most of these cases, the disability e.g. Primary Hypertension, Diabetes Type II or Heart Disease etc is held as NANA by the Release Medical Board (RMB) giving very simple reason i.e.  the disease is constitutional or idiopathic in nature.  
Though there is a provision for filing appeal against the RMB findings but most of veterans either do not file appeals or if filed, the appeals are also rejected by giving same type of reasons as given by RMB.  Thereafter, most of the veterans do not take up their cases further. 
I just wanted to tell my veteran brothers that once the initial claim for disability pension is rejected by Competent Authority/Record Office, they must file appeal against that order.  Even if their appeal is rejected, they should take up their case to Hon’ble Armed Forces Tribunal. In a large number of such NANA cases, the Hon’ble Tribunal has granted disability pension.   Even if your case is an old one then also you must process your case because the pension claim is never time barred as held by Hon’ble Supreme Court as well Hon’ble AFT in a number of cases.
