Dear Veterans,
1. Since receiving RM’s Tweet yesterday conveying Cabinet approval for revision of OROP, followed by PIB Press Release and OROP related OROP Tables, we have received many queries relating to long outstanding anomaly of Brigadiers still continuing to receive higher Pension than Major Generals. These queries are quite legitimate because the terms of reference for revision of OROP does not include above anomaly. Hence, these Tables are OROP specific only.
2. As far as the case of Brigadiers drawing more Pay/Pension than Major Generals and above is concerned it flows out of anomaly that MSP was not admissible to Major Generals and above. There has been long debate/battle to resolve this legitimate anomaly but without any success. Hence, as a last resort legal recourse to put an end to this anomaly has been taken.
3. As per legal advice from eminent Lawyer Major Navdeep Singh Writ Petition had been filed with Punjab & Haryana High Court. The Petition had been backed and duly supported through untiring efforts of Air Marshal Sharad Savur (Retired), RTI expert. It is so gratifying to report that the case has been masterfully handled by Major Navdeep Singh, Pro Bono at no cost to the Petitioners. Accordingly, a foolproof case has found success with tacit No Objection from CGDA and DOP&T for grant MSP to Major Generals and above. P&H HC have decreed in favour of the Petitioners and set a time frame for UoI to implement Court Order. As usual UoI has failed to adhere to Court’s deadline.
4. Hence, in the recent past a Contempt Petition has also been filed. On the hearing date UoI pleaded for more time. HC however, have issued strict orders to implement by 21/02/2023. Copy of the Court Orders being shared separately.
UoI has till 21/2/23 to get the govt letter out.
