Pension is reduced in OROP- II - Reply from PCDA ALLHABAD

Dear Sir,
Some of the officers have informed me that their pension is reduced in OROP- II. I replied to them saying that their pension is not reduced and they will continue to draw their present pension which is higher than that in the OROP - II. I also told them that only minus point is they will not get arrears in OROP- II. But they were not satisfied with my reply. I had another query from some of the officer. They asked me the reason for the difference in pension between Major with 21.50 years and below is much more than 3% per year. I informed them that there could some Majors with less than 20 years' service who are invalided on medical grounds and were sanctioned disability or invalidment pension. Therefore the pension of one Major who actually retired with less service than 20 years was fixed for all majors above his service till 21 years. 
Now PCDA (Pensions) Prayagraj has given Important clarification on this issue as an answer to the queries sought by a Major under RTI Act. The same is shown below: -

Dear Sir,
Regarding your 1st query- this is to inform you that as per OROP Policy letter of MoD dated 04/01/2023, OROP rates are average of Minimum and Maximum pension for a rank of a particular qualifying service from live data of retirees of year 2018. This letter also provides in para 2.3 that   Pension for those drawing above the average shall be protected. Please also refer last lines of para 2 of MoD letter dated 20/01/2023 where clearly provided that the rate of pension of pensioners/family pensioners drawing more than the revised rate of pension/family pension indicated in annexed tables, shall remain unchanged. Therefore, pensioners drawing more than these rates will not be revised or reduced for disadvantage to them. 

           Regarding your 2nd query-  In this context, refer para 4.3 of MoD letter dated 20/01/2023 which clearly provides that

“The OROP rates is average of minimum & maximum rate of pension for a rank and a qualifying service of live data of 2018 retirees. Wherever, the rates of higher qualifying service of a rank are lower than rates of lower qualifying service in same rank or data is/are blank for higher qualifying service then the same have been protected by higher rate of lower qualifying service, due to this many rates in same column appears equal. Similarly, wherever this OROP rate is lower in higher rank than rate in lower rank in same qualifying service then the same have been protected with higher rates of lower rank in same qualifying service resulting similar rate in some qualifying service in two adjacent columns.”

            Therefore, the similar rates in some qualifying services in a rank is due to above reason.

             Regarding your 3rd query-  There were live data for 2018 retirees Majors below qualifying service 20yrs as there were invalidment due to medical reason in this rank and they are getting disability pension.
